What Is Religious Discrimination?

Employers cannot discriminate against applicants or employees because of their religion. This means they cannot treat them differently because they are part of a particular religion or because they choose not to be part of the religion their employer is part of. Discrimination occurs when the employer makes an adverse employment decision or treats an employee or applicant unfavorably because of their religion or religious differences. 

Examples of Religious Discrimination

Religious discrimination can take many forms. Some examples include:

  • An employer refuses to hire people in certain religious groups.
  • An employer refuses to promote, pay raises, or offer benefits to employees based on their religious beliefs and practices.
  • A company implements policies requiring employees to complete practices contrary to their religious beliefs.
  • A manager fails to take corrective action when an employee is subjected to derogatory comments or depictions involving members of their religion by a co-worker or customer.
  • An employer schedules selection exercises or workplace advancement tests that conflict with an employee’s religious practice.
  • A company implements policies prohibiting certain hairstyles or clothing related to an employee’s religion. 
  • An employer prevents an employee from having contact with clients because they are wearing religious attire, such as a yarmulke or head covering. 
  • An employer terminates an employee for taking time off to observe a religious holiday.
  • An employer refuses to accommodate religious practices, such as prohibiting an employee from praying. 

Reasonable Accommodations for Sincerely Held Beliefs 

Employers are required to reasonably accommodate their employees’ or applicants’ sincerely held religious beliefs. For example, if an employee is part of a religious group that practices daily prayer, the employer is required to allow the employee to practice this belief unless it can show that it would present an unreasonable burden on the employer to do so.
