What Is Gender Discrimination?

Gender is a social construct. Society has rules about how a person should act based on their biological sex. However, requiring applicants or employees to conform to traditional social norms is a form of discrimination, known as gender discrimination. State and federal laws prohibit discrimination on a person’s actual or perceived gender.

New York Law on Gender and Sex Discrimination

The New York City Human Rights Law is expansive and provides more protections to employees than similar federal laws. It applies to New York employers with four or more employees or one domestic worker. Under this law, discrimination in the workplace is prohibited when it is based on a person’s gender identity or gender expression.

It is illegal for an employer in New York to discriminate against an applicant or employee because of their actual or perceived gender identity, which may or may not conform to their sex assigned at birth. Therefore, it is illegal to discriminate against an applicant or employee because they are transgender, non-binary, intersex, non-gender conforming, or genderqueer.

Gender expression discrimination occurs when a person is discriminated against because of how they express their gender, such as through their communication or appearance. This type of discrimination is also prohibited in New York. Gender discrimination occurs here simply when a person is treated “less well than others on account of their gender.”
